For most medicolegal cases, utilizing our services is cost effective and can maximize your chance of success in the courtroom. Whether working for Plaintiff or Defense, our only agenda is to provide the best services for our clients.
REVIEW, ANALYZE, AND SUMMARIZE MEDICAL RECORDS
MCLS has reviewed and analyzed hundreds of cases, involving a wide variety of medical situations. Our team has a knack for discerning and assessing the key facts and issues, which may not be readily apparent to attorneys. Summaries of our findings are clear, concise, and analytically insightful. Our team's backgrounds provide a unique level of comprehension and analysis about a wide variety of medical issues. We also know the importance of telling you when a particular topic is beyond our scope of knowledge, and we will tell you when an issue can best be addressed by a specialist in that field. This transparency saves you time and money.
EVALUATE MEDICAL MALPRACTICE AND PERSONAL INJURY CASES
The team at MedCase Litigation Specialties evaluates cases to help attorneys decide whether to further investigate or pursue a case. We help the attorneys understand the medical issues involved and the pros and cons of further action, anticipating what the other side may contend. Our goal is to thoroughly research and analyze your case to inform you which types of experts would be needed if you decide to move forward.
OBTAIN MEDICAL EXPERTS; LIAISON WITH DOCTORS AND ATTORNEYS
Finding the right expert is crucial to being successful with a case. The wrong expert can sink it. We assist attorneys with finding knowledgeable, credible experts with the right type of specialization to address the critical issues. Our medically experienced team is fluent within medical-speak and can achieve better communications between physicians and attorneys.
CREATE MEDICAL CHRONOLOGIES
A medical chronology can be of great value - especially in complicated cases. Rather than going back and forth through length, detailed medical records, we provide you with one concise source. A good medical chronology includes all the relevant details, and just as importantly, leaves out the superfluous ones.
ORGANIZE MEDICAL RECORDS
Properly organized medical records can save attorneys time, money, effort, and frustration in the long run. Especially for litigated cases, organized medical records are highly recommended by our team.
BOOKMARK AND NOTATE PDF’S OF MEDICAL RECORDS
Using Adobe's Portable Document Format (PDF) to create electronic documents of medical records can be very convenient, but without bookmarks they can be frustrating to use. We can make your PDF's much more user-friendly by adding bookmarks (medical tabs, office visit dates, etc). MedCase Litigation Specialties can also add highlights and notes to them in a non-destructive fashion to aid you in finding the information you need. MCLS can also add optical character recognition (OCR) to make the PDFs searchable and give the ability to copy and paste text from one document to another.
RESEARCH MEDICAL LITERATURE AND OBTAIN ARTICLES
There's certainly a lot of medical research out there, but it takes someone with expertise to know what to look for and where to look. Keyword searches will only reveal so much about a medically-related topic. Our experts have extensive experience researching medical literature to uncover potential issues with best practices and record keeping.
IDENTIFY RELEVANT STANDARDS OF CARE, RULES, REGULATIONS, GUIDELINES, AND PROTOCOLS
MCLS can help the attorney determine and investigate standards of care, rules, regulations, guidelines, and protocols that are relevant to the case. These can often be used as the basis for a negligence claim or to potentially protect a client from such a claim.
ASSIST WITH DEPOSITIONS, MEDIATIONS, AND TRIALS
Preparation is the key to being successful with depositions, mediations, and trials. As experienced medical professionals, our team can help the attorney be well-organized and focused for these events. We can also assist with demonstrative evidence and collaborate with other vendors to help you prepare.
PREPARE DEPOSITION QUESTIONS
For depositions with doctors and other healthcare professions, MedCase Litigation Specialties can save you a lot of time and frustration by preparing deposition questions. Our team has done this frequently for our clients with excellent results. With our medical and legal background, we know what questions to ask and when to ask them. MCLS develops strategies for each deponent to elicit answers most helpful to your case.
ASSIST WITH PREPARATION OF LEGAL DOCUMENTS, SUCH AS POP’S AND RFP’S
MCLS can collaborate with the attorney or legal assistant when drafting various legal documents, such as POPs or RFPs. Our team as developed a series of templates to assist in the production of these documents; saving time and money. MedCase Litigation Specialties can also help identify relevant records and other documents for RFP's and subpoena duces tecum.
CONDUCT INVESTIGATIONAL INTERVIEWS
The team at MCLS frequently assists with interviews either by phone on in person. The right medical consultant, such at those on our team, can quickly identify the critical issues and know the right questions to ask. We often do interviews for such things as screening the attorney's potential new clients or obtaining information from treating physicians.
IDENTIFY MISSING RECORDS AND BILLING
Sometimes it's not what you see, but what you don't see. Especially at the onset of a new case, there are usually medical records missing. MCLS can help identify what's missing and determine whether more information would be relevant to the case. Additionally, billing records may inadvertently missing, such as in-hospital providers who bill separately, such as anesthesiologists and radiologists. Identifying missing billing records will add value, especially to a Plaintiff's case.
HELP DEVELOP STRATEGIES FOR SUCCESSFUL RESOLUTION OF CASES
Every case has two sides and each side has it's strengths and weaknesses. As a highly experienced team who has worked for both sides, MCLS can provide an objective assessment and help to develop strategies to maximize strengths while minimizing weakness. We have often been told by Plaintiff attorneys that we were instrumental to their medicolegal case's success. Conversely, when working with Defense, we have been told we saved the hospitals/insurance companies millions of dollars.
